Misdemeanors
Misdeanors in Minnesota are punishable by up to 90 days in jail and a $1,000 fine. Common examples include first-time DWI, simple assault (such as punching someone) or theft of property worth less than $500. Many misdemeanor crimes are enhanceable offenses.
Gross Misdemeanors
In Minnesota, the maximum penalty for a gross misdemeanor is one year in jail and a $3,000 fine. These include a second DWI in ten years, a second assault in ten years against the same victim or theft of property worth between $500 and $1,000. Gross misdemeanors are more serious than misdemeanors, but less serious than felonies.Felony Offenses
A felony-level offense is punishable by at least one year in prison and a fine of over $3,000, depending upon the charge. These are the most serious offenses a criminal defendant can face in Minnesota and a conviction for a felony can have lifelong consequences.Probation Violation
Once a defendant pleads to, or is found guilty of, a crime they are sentenced. Usually, the immediate sentence is followed by a period of probation, during which the defendant must comply with specific conditions. Typical conditions include the completion of chemical treatment, remaining law abiding, paying a fine or performing community work service. When a defendant fails to comply with these conditions the Court may impose additional sanctions and, ultimately, execute the full sentence of the accused.
Juvenile Delinquents
Juvenile matters include any criminal offenses that a person less than the age of eighteen (18) is alleged to have committed. Sometimes, the juvenile court will certify a child to be tried as an adult.
